Tuesday, July 6, 2010
July Market Update for Tampa Bay, Apollo Beach Florida
In this month’s update I would like to share some real life stories rather than give you stats. We all like stories, don’t we? Especially when they are real and have “happy endings”. I recently listed a family’s 4 bedroom manufactured home in the Southshore area because they thought NOW was the time to BUY, and they are so right! We put the property under contract rather quickly (it was priced well) and fortunately the family had a home to move into until we found their new home. Over the course of several months they tried waiting on short sales to get approval from the bank, but found the waiting was too much for them. We tried negotiating with a seller on a non-short sale property, but felt the seller was not being realistic (he didn’t want to pay closing costs and actually wanted to offer a cheaper home warranty than the one requested). We were scheduled to go back and look
again at a short sale we heard was approved when I got a text from a NEW HOME sales rep about some special financing on their inventory homes. We went back into the short sale home and found it had an odor problem we didn’t notice the first time. Then we headed to the new home subdivision. They fell in love with a 2200 sq ft 4 bedroom 2 & ½ bath BRAND NEW HOME in a gated community with a pool, basketball court and playground! All this for only $1200 a month – and that includes principal, interest, taxes, insurance, HOA and CDD!!
They got a 4.25% 30 year fixed interest rate. LESS than RENT!! And the builder is paying $12,000 towards their closing costs and prepaids! Had they bought a short sale or bank owned property, they would buy “as-is”…no warranties, no repairs, and they would have to clean, paint and install new flooring (at least) in most we viewed. The non-short sale they considered had a 10 yr old roof, so in about 5 yrs they would have to replace that and the home had vinyl in the kitchen and baths. Their new home has 18” tile, laminate, granite in the kitchen (with an island and black appliances), brand new carpet and fresh paint. And they have full warranties for the first year, warranty less the appliances the second year, and a 10 year structural warranty. How is that for peace of mind? We even negotiated with the new home builder to include the refrigerator, washer & dryer, and blinds. And they can close in 30 days or less. So they ended up with much more house than they ever dreamed they could afford! I think I will end with this one story this month, and share the story next month of someone who “downsized” from an inland home with lots of yard work to a GORGEOUS WATERFRONT VILLA in Apollo Beach. No more mowing or pulling weeds! There is another happy ending.

By Jim Cramer

Forget the crummy quarter that KB Home just reported. Forget that they still have plenty of liquidity, so, unfortunately for the housing market, they can still pump out new homes just when we want them to cut back.

The real takeaway of the conference call was the housing bottom that they saw in Southern California. It’s huge. They said sales are up by hundreds of percent — that’s the term they used — because the affordability is the best in 20 years, and rates are the best in 47 years.

Two years ago, KBH’s Southern California (KBH- commentary- Cramers Take) home business hit a retaining wall going 200 miles an hour. It has seen nothing but price cuts and foreclosures and cancellations in its projects ever since … UNTIL THIS QUARTER.

In this quarter, they saw month-to-month-to-month stronger sales, as housing prices are down as much as 45% in some of their sales areas (you can see all of them by going to their Web site).

I think the case can be made that it is time to buy there. You don’t get a sense from the call that any other place in their network has bottomed. In fact, they almost all have further to go down.

But not Southern California, where they are selling out, particularly of the $200,000 homes. Oh, and they made very clear that there is ample FHA money available to buy there.

It’s just a remarkably positive housing story within the house of gloom, and a perfect harbinger of what will happen later this year with price declines in the rest of the country.

Get this: KB Home is actually running out of inventory and selling new homes at the same price as foreclosed homes. Hence the fabulous affordability.

No wonder the stock is up!

At the time of publication, Cramer had no positions in the stocks mentioned.

If you’re being sued by any entity acting as a trustee, i.e. “US BANK
as trustee for the HP Series 2006-c Certificate Holders”, you need to
be aware of a variety of issues that may be helpful in your case. I
will start another series of video blog posts on the “Capacity
Argument”, because this argument works in nearly every case, but it is
particularly appropriate in cases where Plaintiff is an exotic,
alphabet soup Foreclosure Frankenstein.

Individual mortgages originated by lenders like New Century and Argent
were pooled into groups of approximately 8,000 mortgages from around
the country to form a Mortgage Trust which held mortgages which had
(on paper at least) cumulative values of between 10-12 million
dollars. These mortgages that were grouped together and given a name
like “HSI ASSETT SECURITIZATION CORPORATION TRUST 2006-OPT2″.
Interests in these mortgage trusts were then sold to teachers unions,
investment funds and other institutional sources around the world.
Before selling the interests in these trusts, the institutional
investors were required to prepare the contract that would govern the
rights between the depositor of the mortgages, trustee of the new
trust and the company that would be responsible for collecting
payments from homeowners and sending those payments out to those who
had invested in the trust. This contract is called the Pooling and
Servicing Agreement. The important thing about the Pooling and
Servicing Agreement is you will find in virtually every case that all
of the parties who are involved violate nearly every provision of
their own Pooling and Servicing Agreement. This has important
consequences that we will talk more about later, but the Securities
and Exchange Commission rules requires these trusts to provide
important other reporting information that was widely ignored or
worse, falsified by the entities in control of these trusts. Finding
such information can be a key to defending your case.

The Securities and Exchange Commission Edgar Database can be found
here. You can also put the name of your Frakenstein, Alphabet Soup
Trust into quotes, “The IXIX 2006-A Trust” into a straight google
search and see what comes up. Here are Step-By-Step instructions:

Finding Pooling And Servicing Agreements (PSA’s)
For Securitized Mortgage Loans

The “Pooling and Servicing Agreement” is the legal document that
contains the responsibilities and rights of the servicer, the trustee,
and others over a pool of mortgage
loans. The Pooling and Servicing Agreement can be a stand-alone
document or it can be part of another paper, usually called the
“Prospectus.” If the securitization is public,
these documents must be filed with the Securities and Exchange
Commission (SEC), and will be available to the public at www.sec.gov.
Locating a Pooling and Servicing
Agreement on the SEC website can be a challenge. The most important
information you will need to find the Pooling and Servicing Agreement
is the name of the original lender and the title of the pool of loans.
We will work through an example below. Assume that the lender is
Ameriquest Mortgage Co. We don’t know the name of the pool that the
homeowner’s mortgage ended up in, but we
do know that the mortgage was made on June 1, 2002.

Step One:
Go to www.sec.gov and click on “Search for Company Filings” under
“Filing & Forms (EDGAR).” Under “General-Purpose Searches,” click
on “Companies & other filers.”
Then, in the “Enter your search information” box, type in “Ameriquest”
next to “Company name” and click on the “Find Companies” button.

Step Two:
The page you are now looking at shows a long list of the names of
securitized pools of loans. We know the mortgage was made on June 1,
2002. Look for the entry titled
“AMERIQUEST MORT SEC INC ASS BK PAS THR CERTS SER 2002 2.” The
document number is CIK 0001175125. Click on that number. We selected
this entry
because it said 2002 on it and the loan in question was made in 2002.
There may be several other pools of mortgage loans that Ameriquest
securitized in 2002 but this is the
first one we come to on this list (when reviewed in late February
2007) so we will pull it up.

Step Three:
Now you see a list of documents filed with the SEC that are related to
this pool of loans. Scroll down to the bottom and you will see a
document titled “Prospectus.” This is the
document that will likely be the one you want, assuming that the
mortgage loan you are concerned about is in this pool. We can only
make an educated guess, unless you knowthe name of the securitized
pool in advance (which is unlikely). Click on either “htm or text”
next to this document and the Prospectus will appear. Now,
bookmark this document on your web browser, so you can come back to it
easily in the future.

Step Four

Is this likely to be the document you want? Scroll down to page S-2
and you will see a
Table of Contents. Included in that is the “Pooling and Servicing
Agreement” which
starts on page S-76. Also, scroll down one more page, past the Table
of Contents, and
you will see a “Summary of Prospectus Supplement.” Certain important
information is
listed there, including the cut-off and closing dates for loans that
will be included in this
pool. The closing date is June 7, 2002. Based on this information,
you can assume that
this document governs the responsibilities of the servicer of the
mortgage loan in
question, unless that servicer tells you otherwise and can back it up
with a reference to a
different agreement or pool. Other important information listed in
this Summary includes

the title of the pool, and the
identity of the servicer and trustee. The servicing rights may have
been sold since this
document was filed and the current servicer may be a different company
but the trustee
(the legal holder of the mortgage) should be accurate.

Step Five:
Go the Pooling and Servicing Agreement to find what you need to know. It should
describe how the servicer is paid and by how much, who keeps late and
other fees, what
authority it has to modify the loan or engage in workouts with
homeowners, and its
obligations to pass mortgage payments on to the trustee.

Some of the best information I get comes from intrepid consumer
researchers out there who care enough to dig into these things.
Perhaps the most powerful thing about this and other online forums is
the ability for consumers and advocates to share what they’ve found.
In my estimation, what this pro-se Defendant found is enough to blow
the lid off his foreclosure case…..read on:

I was served Lis Pendens last month, (April 2010), naming the
plaintiff Deutsche Bank National Trust Company, As Trustee for HSI
ASSETT SECURITIZATION CORPORATION TRUST 2006-OPT2 MORTGAGE
PASS-THROUGH CERTIFICATES, SERIES 2006-OPT2

I looked into the records for that entity in the SEC EDGAR online
database and discovered that the last annual report was filed in 2007,
contemporaneously with a FORM 15 filing.That Form 15 filing claimed a
standing under 15d-6 of the 1934 SEC regulations which exempts the
entity of filing an annual report, whereby the number of claimed
investors had fallen below the SEC registration and reporting
threshold of 300 persons. ( To my understanding, the same Form 15
filing is also used when a registered, reporting, entity is
dissolved.)

I then began looking at many other securitized trusts in the EDGAR
database. Literally dozens and dozens of these securitized trusts have
done exactly the same thing. he trust is established and appropriate
SEC documents are filed for a period of time, usually 1 or 2 years.
The trust then files a Form 15 claiming exemption of the obligation to
file reports with the SEC under 15d-6

The paper trail for the Trust with the SEC thereby *ends* Many of
these trusts have not filed anything with the SEC for years. Many as
far back as 2005 and 2006

Some of the SEC Form 15d-6 filings disclosed as few as 15 or less
investors. Bear in mind, these are for trusts that purportedly hold
well over $1 BILLION in mortgages, and there are dozens and dozens of
these trusts with a mere hand full of investors! I also noted that the
“agent of record” of many of these trusts have changed many times, and
are very infrequently “named”, but list only an address and phone
number, (usually in New York). In several of the cases I’ve looked at
in the EDGAR database, I actually called some of the phone number
listed at 3:00am EST and got the voicemail of someone at a bank in
N.Y. Note that the answering party was NEVER a bank listed as the
Trustee, (as Deutsche Bank is in my case), or the trust
“administrator” as listed in the PSA or any subsequent SEC filings.

I actually got the voicemail of some fellow at HSBC Bank who was the
“anonymous” contact in my case! My point is this;

Has anyone actually verified that the securitized trusts claimed to be
under the trusteeship of some of these banks still ACTUALLY EXIST?

We’ve been so focused on the NOTE and the fraudulent paper being slung
about for assignment of those notes, and whether or not the
“plaintiff” has standing to bring the foreclosure action, has anyone
thought to see if the “plaintiff trust” is even still active or not?
Were many of these trusts actually dissolved after payouts from credit
default swaps and TARP funds and the actual investors now long gone?
We have no records to show whether they are alive or dead. Most of
these trusts haven’t filed anything with anyone in years as far as I
can tell.

Certainly, as in my case, Deutsche Bank, (as Trustee), still exists,
but can these plaintiff securitized trusts be made to *prove* they
still exist?

What happens to a foreclosure case if the plaintiff entity,(the
securitized trust, *not* the Trustee for it), no longer exists or
cannot prove it exists?

IT’S TIME FOR ME TO GET BACK TO AN ISSUE THAT I HAVEN’T TALKED ABOUT
FOR A WHILE AND IT IS THIS CAPACITY ISSUE…BECAUSE IT STRIKES AT THE
HEART OF THESE CASES. SIMPLY PUT, A TRUSTEE CANNOT MAINTAIN AN ACTION
ON BEHALF OF A TRUST THAT DOESN’T EXIST.

STAY TUNED AND GREAT WORK FROM THE PRO SE WHO SHARED THIS INFORMATION.

When you think about palm trees you immediately think of an island with fresh sand, icy blue water and beautiful palm trees. Being the pretty trees they are they seem to bring peace. Some people have them growing in their big gardens and they look amazingly exquisite there too. It’s like when you think of happiness you think tall palm trees blowing in the wind.

They grow mostly in coastal regions where it is warm and there is a lot of sunshine. They are more likely to be found near water but they may also grow in deserts. The leaves of a palm tree might remind you of a big feather, just green. It’s mainly just a big trunk with no leaves until you get to the top where all the leaves are. They also produce fruits called coconuts. This is why if someone happens to get deserted on an island somehow (like in the movies) they will not starve because most islands have palm trees.

The coconut is spherical in shape and is brown in color. These fruits are hollow therefore they are able to float on water. They are able to float on the water for a long period of time but after that the salt of the sea water will have destroyed the seed.

If you are thinking of planting a palm tree in your garden or you have just discovered that there is already a small one growing, there are ways for you to care for it to ensure that it grows into a beautiful healthy tree. It is easy to grow a palm tree, all they really need is good soil and lots of water, but be careful not to over water it or it will die. Just give it a fair amount of water every three days and your plant will be well on its way!

Are you a travel fanatic? If the answer is yes, then here are the top 10 travel destinations you should consider visiting this year and a few reasons why.

Colombia: a place you just have to visit, with its plenty of momentum, friendly people, Colombia has a natural beauty and a country that is fun and safe to explore.

The coastal Caribbean city of Cartagena has great tourist infrastructure mixed with its colonial architecture and history. All the major cities here have fairly large International airports, and flights are often easier and cheaper.

Panama: when you mention Panama, what comes in the mind is canal. While you may not hear much about it, this country has lots of tourists’ attraction sites than canals only. Panama has a little bit of everything to offer travelers from the lush jungle highlands to excellent surf ad beaches on the pacific side. Add the mix friendly people with diverse and rich culture and you have yourself an equation for a perfect destination.

Cambodia: Siem Reap is just a bit south of Bangkok and it offers a far more authentic and less slick look into the culture while still having well developed infrastructure. One of the benefits here is Angkor Wat temple complex, most visitors use it as a staging area for their time.

Argentina: Bariloche in Argentina is a city jammed with winter and summer activities. Its stunning scenery in almost all directions makes it popular among those touring different places in the region.

Australia: the island of Tasmania in Australia though it’s a small state is enough to keep most travelers occupied for the entire trip, with its incredible landscapes, national parks, nature reserves and world heritage sites are just but a few great options to fill your days in Australia.

Bangladesh: This is definitely a place worth to look for when travelling to Asia. The capital city Dakar is the obvious place to start with, the people here are welcoming and friendly. The port city of Chittagong and Cox’s Bazar the worlds longest beach are some of the must go places in Bangladesh.

Italy: travelers need not to be told to go to Italy, but many people need to be told about the many big Italian Island besides Sicily. Sardinia is one of them; it has long been a vacation destination for Italians. It’s a haven for anyone who loves the outdoors.
Senegal- If you are looking to explore the real Africa you should consider visiting Senegal as your entry point. Its fascinating and easily accessible culture makes it a safe place to be.

Germany: fun loving? Berlin in Germany is fairly filled with interesting and amazing new tourist attraction. It has plenty going for including a feel that is somewhat exotic compared to some other countries.

Syria: Damascus in Syria is one place where you can feel like you are truly stepping back in time. It is the oldest city in the world but this part of the city looks, smells and sounds like it did long ago. It’s full of history and credibly affordable.

So every one, 2009 is the year of travelling to your destination go for it!

As the summer holiday makers start heading home, Paphos turns from a bustling Mediterranean destination back into a sleepy small town or as some say, a village. I have concluded my second consecutive summer here and anticipating the beauty of the coming autumn and winter seasons, I would like to share a few points about Cyprus for interested vacationers, people relocating and intending to buy property and live here, or anyone just interested in reading.

The thing that weighed heavy on my mind about moving to another country was learning a foreign language. Once my wife, son and I decided to move to Cyprus for the next few years and live close to our family I immediately purchased books for learning Greek. I feared the possibility of failure, but I approached it with determination and enthusiasm anyway. Unfortunately, the results were not good, any words learned were quickly forgotten. I hoped that maybe in Cyprus it would be easier. I was right, once we arrived I was able to pick up words much more easily and within weeks I had memorized forty words. At that pace by the end of the year I would be fluent which brings me to my first surprise.

My biggest surprise is that I now know less than I did before. The reasons are that most people speak English and many English speaking residents are not attempting to learn. I asked a few people about how good their Greek was, to see how long it usually takes to learn and to get some kind of average. I was very surprised to hear them tell me that they don’t speak and were not going to try. People who on first impression I would of picked as someone who would learn, and quickly had no interest. I have learned a lot since I have been here and I will learn Greek, I promise.

The second thing that concerned me was the anticipated culture differences or “shock” having come from the US. We were used to many things that are not available, (good and bad) but that’s another story. I feel no shock; of course we miss things such as the great television programming we were used to in America and the vast amount of choices. In Cyprus however, we have lots of real, quality, family time.

What is also surprising is the decline of the tourists in the non summer months. Yes, I know kids go back to school and parents get back to work however, to me everyone is coming here at the wrong time of year. The weather in Cyprus is absolutely wonderful all year round and the millions of tourists that visit this island only come when it’s absolutely blistering hot. The only thing to do at that time is to bear it and try and stay cool, and of course tan or burn which ever you prefer.

Living most of my life in Chicago and dealing with those types of harsh winters, I feel like I live in paradise during December and January. I sell homes and as I talk to home owners listing property with me to sell, I ask what kind of heating they own so we can write it in the description. I feel silly asking but not everyone is as immune to the cold as I am and the winters are seem mild to me anyway. One message that’s repeated on many websites promoting Cyprus is “340 days of Sunshine.” Well they are not lying and they need to push this message a little harder.

Another surprise is the actual population, or the lack of it. I must confess that I did a lot of research about the country, I looked at statistics regarding just about every aspect of the country and the region including history and especially business related issues, trying to figure out where my experience would be best fitted. I did not consider the small local population because the one time I visited Cyprus it was during the summer months and all the hotels, apartments and villas were full of people. I did not realize that they would only remain full for such a short time.

The cost of living was yet another shock. I thought coming from the U.S. to a small country meant a lower cost of living, especially since things I associated with higher standards such as fancy malls, theme parks, zoo’s, museums and theatres are not available in Cyprus. I accepted a high cost of living when I moved to Washington D.C. from Peoria, IL because there were reasons for the high price and I took advantage of them. In Cyprus, I couldn’t justify the even higher cost, until now.

What is it that makes Cyprus worth the price? The answer is of course my own personal beliefs obtained from observations and conclusions I feel strongly towards. First is the lack of crime, there is a feeling of safety that I have here that I never had anywhere. I forget to lock my house doors even when I leave to go far, I leave my car windows rolled down, and I don’t worry about my kids being abducted and other things you see in the news.

Second is the lack of pollution, not only are we in a country with the main source of revenue from tourism and agriculture, add the fact that we are in the middle of the Mediterranean sea, north of the least industrious continent Africa. I am not a scientist but I don’t see any obvious source of pollution and I feel the difference. The final point is the lack of time my family and I spend in traffic. There is no traffic, yes there are times when a driver might do something to delay a few drivers behind him or I see the occasional accident that has brought everyone to watch and wait for the policeman to arrive to record and measure all details for his report, but that only happened once and it lasted for five minutes. The time gained is spent doing meaningful things with family and friends in a stress free, unpolluted, beautiful part of the world.

Every Memorial Day weekend, the summer season officially kicks off in the Hamptons and with it comes the droves of movie stars and city dwellers seeking to escape the heat and enjoy some of the most breathtaking beauty New York State has to offer. While largely known as the summer vacation spot for the rich and famous, rubbing elbows with your favorite director or movie star has never been easier when you spend your vacation getaway along the beaches of a stunning Hamptons town.

Offering some of the best beaches in the world, the Hamptons are definitely the place to be for exciting oceanfront adventures. While there are excellent sandy options up and down the South Fork, East Hampton’s Main Beach is consistently rated one of the top ten beaches in the country and is ideally located in the new-money capital of Long Island. The likes of Martha Stewart, Steven Spielberg, and Jerry Seinfeld own homes in this trendy town, and you can certainly spot a few other celebrities while you relax along the clean white sands of East Hampton beaches such as Wiborg Beach, Egypt Beach, and Georgica Beach.

Although the Westhampton area, including the incorporated villages of West Quogue, Westhampton Beach, and West Hampton Dunes, is considered a little more like Long Beach than the rest of the Hamptons, visitors can still enjoy all of their favorite activities, including swimming, jet skiing, boating, surfing, and sunbathing, at the entertaining Pike’s Beach. However, if you prefer an old money atmosphere and huge waterfront estates as the backdrop for your beach excursions, then Southampton and the Flying Point Beach may be more your style.

For a low-key getaway away from the hubbub and noise of the party scene, set your vacation compass for a town like Amagansett and Bridgehampton. In the quant Bridgehampton, you can enjoy the popular Mecox Beach before heading over to a nearby winery, while in Amagansett, shopping in fine boutiques and dining on exquisite cuisine are the order of the day. Nightlife is never dull here, either, as Amagansett is home to the famous Stephen Talkhouse, a small, standing-room only club where the likes of Paul McCartney and Paul Simon have been known to show up unexpectedly.

In addition to the popular Stephen Talkhouse, the Hamptons are home to numerous other forms of entertainment and nightlife. The Westhampton Beach Performing Arts Center hosts professional musical, dance, and theater performances year-round, while the Bay Street Theater in Sag Harbor presents up-and-coming plays in addition to time-honored classics on its stage. Once the sun has set on the Hamptons, visitors can also enjoy a late night drink at the Cigar Bar in Sag Harbor or attempt to get into one of the super trendy bars such as the NV Resort in East Hampton or Jet East in Southampton.

When looking into popular Hampton attractions, there are two that always stand above the rest. Located in an 1845 mansion built by Benjamin Huntting, a whaling-ship magnate, the Whaling Museum in Sag Harbor pays homage to the industry that put this region on the map. Featuring samples of whale oil, century-old whale jawbones, and the tools and weapons of whalers, the museum is a must-see on any Hamptons trip. The Montauk Point Lighthouse, completed in 1796, was the first lighthouse to be built in New York State and is the home of numerous artifacts and historical documents. The best part of any visit, however, is the climb up the 110-foot tower for a breathtaking, panoramic view of the ocean, coastline, and stunning scenery.
